Essential Auction Rules & Terms to Understand

Strict As-Is Wholesale Rules

Grades and notes are determined by official auction hall inspectors. Wholesale auctions are sold strictly as-is without dealer consumer warranties.

Your Max Bid is Legally Binding

A winning bid at or below your authorized ceiling is binding. Changing your mind forfeits the security deposit to cover venue cancellation penalties.

No Cooling-off Period

Store consumer cooling-off rules do not apply to commercial auto auction proxy bidding mandates under Japanese law.

Auction Proxy Bidding FAQ

Why are there two separate agreements for Export and Japan Domestic?
Overseas export is 100% exempt from Japanese 10% domestic consumption tax and requires an MLIT Export Certificate (輸出抹消仮登録証明書) for vessel loading. Domestic use requires Japanese taxes, 2-year Shaken, garage certificate (車庫証明), and official name transfer at the Transport Bureau. The legal and tax responsibilities are completely different.
What happens if the vehicle is won below my maximum bid?
You only pay the actual winning hammer price! For example, if your authorised maximum bid is ¥1,000,000 but the auction hammer drops at ¥780,000, your purchase cost is ¥780,000 plus standard fees. You keep the entire ¥220,000 difference.
If the vehicle is not won, is my security deposit refunded?
Yes, 100% refunded promptly (minus nominal bank transfer fees), or rolled over to another auction vehicle of your choice at zero extra charge. Deposits are only forfeited if a buyer refuses to honour a winning bid within their authorised written limit.
Can foreign residents bid on cars for driving inside Japan?
Yes! As long as you possess a valid Residence Card (在留カード), Certificate of Residence (住民票), registered inkan (or signature affidavit), and a designated parking space, KMC JAPAN handles the entire title transfer, shaken inspection, and license plate registration for you.
What if the delivered car differs from the auction inspection sheet?
Auctions operate under strict wholesale as-is rules. However, major hidden mechanical defects (engine knocking, transmission slippage, undisclosed structural chassis repair) are covered under the auction house 3-day claim window. We file arbitration claims immediately if discrepancies are identified.
Do I need my own Japanese auction membership?
No. KMC JAPAN is a licensed auto dealer and official terminal member across USS, TAA, CAA, JU, ARAI, and MIRIVE. We act as your licensed broker and legal agent.
